assistance in mergers and the drafting of vertical and horizontal
agreements.
We
have a network of international contacts that permits us to successfully manage
transnational agreements and distribution networks.
In
recent years, the powers granted to the competition authorities have increased
significantly. Their ability to influence business activities has a
strong impact on companies and ultimately determines their conduct. Authorities can
investigate and impose sanctions, and therefore being virtuous and putting in
place effective strategies and risk management is important for companies,
whatever their sector of activity may be.
Our
team has therefore developed compliance and audit systems that are adapted to
the specific needs of the client.
Additionally,
the diffusion of actions before civil courts, especially requests for interim measures
and claims for damages, has allowed us to extend our expertise into the field
of so-called private enforcement.
RECENT WORKS
- Assisting a company in a complaint alleging
abuses of dominant position before the Italian Competition Authority
- Advising a company in the negotiation of a tolling agreement with the competitor
- Preparation of an antitrust compliance program
including a preliminary audit and subsequent trainings as well as the
revision of the Client’s code of ethics
- Represented an undertaking in a cartel case before the Italian Competition Authority. The proceedings were closed without finding any infringements carried out by our client, while the other companies involved in the case (except for one) were all sanctioned
